This Privacy Policy is designed to help you understand how Covalent Labs Holding Pty Ltd trading as 1KE ("1KE", "we", "us", "our") uses, protects, and shares your personal information, and how you can exercise your privacy rights. This Privacy Policy applies to personal information processed by us, including our products, services (including support services), and websites (collectively, the “Services”).

“Personal Information” or “Personal Data” is information or an opinion, whether true or not and whether recorded in a material form or not, about an individual who is identified or reasonably identifiable.

Guiding Principles.

We collect, use, and disclose personal information only as reasonably necessary to deliver our Services, tailor and optimize our Services to drive your success, operate our business, and fulfill our legal obligations.

Our Services do not involve selling personal information to third parties for monetary consideration.

This Privacy Policy considers the requirements of the Privacy Act 1988 (Cth). Individuals located in the European Union (“EU”) and United Kingdom (“UK”) may also have rights under the General Data Protection Regulation (“GDPR”).

An Important Note on “Customer Data” Processing.

This Privacy Policy does not apply to any of the personal information that we process on behalf of our customers through their instruction and use of our Services (“Customer Data”). Our Customers’ respective privacy policies govern their collection and use of Customer Data. Our processing of Customer Data is governed by the contracts that we have in place with our Customers, not this Privacy Policy.

The categories of personal information we collect depend on how you interact with us, our Services, and the requirements of applicable law. Examples are listed below.

  • System Security and Monitoring - Monitor usage patterns, detect fraud or abuse, ensure system availability, and maintain security using technical usage and profile information.
  • Financial Management - Handle internal record keeping, administrative tasks, invoicing, billing, and subscription payment tracking using identity, contact, financial, and transaction information.
  • Business Development and Analytics - Conduct internal analytics and research, improve business operations and performance, and develop applications and social media platforms using profile, technical usage, and professional information.

Information Disclosures to Third Parties

We collect, use, and disclose personal information only as reasonably necessary to deliver our Services, tailor and optimize our Services to drive your success, operate our business, and fulfill our legal obligations.

For these purposes, we may disclose your information to:

  • Service Delivery Partners - Our employees, contractors, and trusted third party service providers (including hosting providers, payment processors, analytics vendors, and professional advisors) who assist us in delivering our services to you.
  • Business Collaborators - Selected partners, affiliates, resellers, distributors, and event sponsors who help us provide localized services or enhanced experiences, and only where you have provided consent through registration or event participation.
  • Legal and Regulatory Authorities - Courts, regulatory bodies, and law enforcement when required by law or to protect our legal rights and interests.
  • Corporate Transaction Parties - Professional advisors and potential acquirers in the event of a merger, acquisition, or business restructuring, where your information may be among the transferred business assets.

Our Services do not involve selling personal information to third parties for monetary consideration.

International Transfers.

Your personal information may be stored or processed outside Australia, including in the United Kingdom and United States, by our service providers and partners. All international transfers comply with Australian Privacy Principles and applicable global privacy protection requirements.

Third Party Responsibilities.

When we share information with third party services, their handling of your information is governed by their own privacy policies. We are not responsible for the processing of personal information by third party services and encourage you to review each third party service’s privacy policy.

Storage and Security

1KE is delivered in a secure, multi-tenant architecture within a private cloud (VPC) using Google Cloud Platform (GCP) infrastructure with data stored and processed in Australia.

Information Retention

We retain your personal information only as long as reasonably necessary to fulfill the purposes we collected it for, including satisfying legal, regulatory, tax, accounting, or reporting requirements. We may retain information for longer periods if a complaint is filed or we reasonably believe litigation may arise regarding our relationship with you.

To determine appropriate retention periods, we consider the amount, nature, and sensitivity of the personal information, potential risks from unauthorized use or disclosure, the purposes for processing and whether we can achieve those purposes through other means, and applicable legal, regulatory, tax, accounting, or other requirements.

Your Privacy Options & Rights

Your Privacy Options.

The privacy choices you may have about your personal information are determined by applicable law and are described below.

  • Email Communications - If you receive an unwanted email from us, you can use the unsubscribe link found at the bottom of the email to opt out. Note, you will continue to receive and cannot opt out of transaction-related and non-promotional emails regarding your Services (e.g., communications regarding our Services or updates to our Terms or this Privacy Policy).
  • Text Messages - If you receive an unwanted text message from us, you may opt out of receiving future text messages from us by following the instructions in the text message.
  • Device Notifications - We may send you push notifications through our applications on various devices, including mobile devices and computers. You may opt out from receiving these notifications by changing the settings on your device or within the application.
  • Phone Calls - If you receive an unwanted marketing phone call from us, you may opt out of receiving future phone calls from us by following the instructions which may be available on the call or by otherwise contacting us as set forth in “Contact Us” below.
  • Do Not Track (“DNT”) – DNT is a privacy preference that users can set in certain web browsers. Please note that we do not respond to or process DNT signals or similar mechanisms transmitted by web browsers in line with industry practice.
  • Cookies Controls - You can manage your cookie preferences on our website or by adjusting your browser settings to accept, block, or delete cookies. However, blocking strictly necessary cookies may prevent access to parts of our Services.

Your Privacy Rights.

In accordance with applicable law, you may have the right to:

  • Request Access to your personal information. There may be legal bases to withhold access in some situations. If we cannot provide access, we will explain our reasons and available complaint mechanisms. Where possible, we will provide access in an alternative form that meets your needs.
  • Request Correction of your personal information where it is inaccurate, out of date, incomplete, irrelevant or misleading. In some cases, we may provide self-service tools that enable you to update your personal information.
  • Request Restriction to our processing of your personal information.
  • Request Deletion of your personal information.
  • Request to Opt-Out of Certain Processing Activities including, as applicable, if we process your personal information for “targeted advertising or engage in “profiling” (as such terms are defined by applicable privacy laws).

Miscellaneous Policies

  • Business Use - Our services are designed for businesses and not intended for personal or household use. We treat all personal information covered by this Privacy Policy as pertaining to individuals acting as business representatives, rather than in their personal capacity.
  • External Links - Our services may contain links to third party websites, services, or applications not owned or controlled by us. We are not responsible for the privacy practices, policies, or content of such third parties. This Privacy Policy applies only to our services. We encourage you to review the privacy policies of any third party sites before providing them with personal information.
  • De-identified and Aggregated Insights - We may create anonymized and aggregated datasets by removing identifying details from your personal information and combining it with other users. This can create helpful insights about usage patterns and preferences (e.g., "80% of users prefer feature X") which contribute to enhancing our Services while protecting your privacy. De-identified and aggregated information will no longer constitute personal information.
  • Publicly Shared Information - Our Services may include features that allow you to share information publicly, such as comments, forums, and community posts.
